Uplift App and Uplift.Chat Website Terms of Use

These Uplift App and Uplift.Chat Website Terms of Use (“Terms of Use”) apply to 23One, LLC’s Uplift App available on the iOS and Google Play Platforms and the website located at https://Uplift.Chat (or any successor web site(s) thereto) (the “Uplift App” and the “Website,” respectively). The Uplift App and Website are the property of 23One, LLC (“23One”). For clarity and as a general matter, these Terms of Use focus on such items as the rules and guidelines for using the Uplift App and Website, including content policies, acceptable user behavior, and intended versus non-intended and prohibited uses of the Uplift App and Website, and the Uplift App End User License Agreement (“EULA”) focuses on such items as the licensing terms and restrictions related to the Uplift App's software and 23One’s intellectual property rights therein. The description in the immediately preceding sentence is not inclusive of all topics addressed in these Terms of Use and the EULA, so you should read both documents carefully.

IN ORDER TO DOWNLOAD, ACCESS, OR USE THE UPLIFT APP, YOU WILL NEED TO AGREE TO THE EULA AND PRIVACY POLICY. IN ADDITION, BY USING THE UPLIFT APP OR THE WEBSITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT USE THE UPLIFT APP OR THE WEBSITE.

23One reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Website following the posting of changes will mean that you accept and agree to such changes. Subject to and conditioned upon your compliance with these Terms of Use and the EULA, 23One grants you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Website.

Purpose; Intended Uses; Improper Uses; Emergencies and Disputes

The Uplift App offers Bible-based guidance, encouragement, and education to help you grow in your faith, including scriptural insights, prayer suggestions, and practical advice for Christian living. It reflects traditional Christian teaching, but is not a substitute for your church, pastoral care, professional counseling, or emergency services. Remember that AI-generated responses may contain errors or be unable to address complex situations. In times of crisis or for important spiritual decisions, seek guidance from trusted church leaders, counselors, or emergency services, and continue to nurture your walk with Christ through Scripture, prayer, and community.

Intended Uses of the Uplift App and Technical Limitations

BY ACCESSING AND USING THE UPLIFT APP, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING INTENDED USES AND TECHNICAL LIMITATIONS, AND YOU AGREE NOT TO ENGAGE IN THE FOLLOWING NON-INTENDED USES OR MISUSES OF THE UPLIFT APP:

• Provide faith-based encouragement and spiritual support using AI-generated content.
• Help users explore biblical wisdom, prayer, and daily reflection rooted in Scripture.
• Offer a companion-style experience that promotes hope, truth, and emotional well-being.
• Support, but not replace, the local church, pastoral care, or professional counseling.
• Encourage users to grow in their relationship with God through biblical engagement and spiritual practices.
• Provide practical advice to live according to Christian principles.

Examples of Intended Uses

• Asking for biblical perspectives on life challenges.
• Exploring theology, doctrine, or Christian history.
• Finding encouragement during difficult times.
• Building habits of daily devotional and prayer.
• Discovering ways to apply specific Bible passages to your daily life.

Technical Limitations

• Content is AI-generated and may contain errors.
• Not all situations may be fully understood or addressed.

Non-Intended and Improper Uses of the Uplift App

• As a Substitute for Professional Help. The Uplift App does not replace pastoral counseling, medical advice or crisis support.
• Legal, Financial, or Crisis Guidance. The Uplift App is not authorized to give professional legal, financial, or emergency advice.
• Manipulative, Harmful, or Illegal Activity: You may not use Uplift APP to promote hate, misinformation, abuse, harassment, or any unlawful actions.
• Doctrinal Debate: The Uplift App is not a platform for debating theology or attacking others’ beliefs.

Emergencies & Disputes

• In a crisis, do not use the Uplift App to resolve the situation -- Contact emergency services, a counselor, or your church immediately.
• The Uplift App cannot resolve complex theological disputes—seek further study and guidance from your pastor.

Content; User-Provided Content

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code, including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such content, contained on the Uplift App and the Website (collectively, “Content”) is owned, controlled or licensed by or to 23One, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.

Other Prohibited Uses

• No scraping, bots, or data extraction methods.
• No hacking, mining, or unauthorized access.
• No vulnerability testing or bypassing security.
• No harvesting or soliciting personal data.
• No imposing unreasonable loads on the system.
• No impersonation or misrepresentation.
• No unlawful activities or solicitation of illegal activity.

Purchases; Other Terms and Conditions

Additional terms and conditions may apply, and be provided to you or posted in the Uplift App or Website, with regard to purchases of goods or services and to specific portions or features of the Uplift App or Website, including, without limitation, [events, groups, polls, surveys, contests, sweepstakes, promotions or other similar features], all of which terms are hereby incorporated by reference within, made a part of, these Terms of Use. You agree to abide by such other terms and conditions, including, without limitation, where applicable representing and warranting that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Terms of Use and any term(s) posted by 23One for or applicable to a specific portion of the Uplift App or Website or for any service offered on or through the Uplift App or Website, the latter term(s) shall control and apply only with respect to your use of that portion of the Uplift App, Website, or the specific service.

Accounts, Passwords and Security

Certain features or Content offered on or through the Uplift App or Website may require you to create an account (including setting up an Uplift App username and password). You are entirely responsible for maintaining the confidentiality of your account information, including, without limitation, your password, and for any and all activity that occurs under your account. You agree to notify 23One immediately of any unauthorized use of your account or password, or any other breach of security. However, you may be held liable for losses incurred by 23One or any other user of Uplift App or visitor to the Website due to someone else using your Uplift App username, password or account. You may not use anyone else’s Uplift App username, password, or account at any time. 23One cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

Privacy

The Privacy Policy (“Privacy Policy”), applies to your use of the Uplift App and Website, and its terms are hereby incorporated by reference within, and made a part of, these Terms of Use. 23One uses industry standard procedures and protocols that are designed to protect your personal information and from unauthorized access and use by third parties. However, by using the Uplift App or Website, you acknowledge and agree that Internet transmissions, cloud storage servers, and data center facilities are never completely private or secure. You understand that any message or information you send through the Uplift App (including, without limitation, verbal or chat messages) or to or through the Website may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted, and you hereby acknowledge and agree that 23One shall not be liable or responsible for any disclosure or loss of data that you send through the Uplift App or that you send to, through, or post on, the Website or on the computer servers of 23One or its third-party service providers.

Any feedback, comments, input, recommendations, ideas, or other information you provide at, to, or regarding the Website or the Uplift App shall be deemed to be non-confidential. 23One shall be free to use such information on an unrestricted basis.
